1. Scope
These General Terms and Conditions (GTC) apply to all contracts, services, and offers from Sightseeing Avenue. Any differing terms from the customer are not recognized unless Sightseeing Avenue expressly agrees to their validity in writing.
2. Conclusion of Contract
The contract between the customer and Sightseeing Avenue is concluded upon a booking by the customer and the corresponding booking confirmation from Sightseeing Avenue.
3. Services
Sightseeing Avenue offers city tours and related tourist services. The exact scope of services is determined by the respective service description on the website or by individual agreements.
4. Prices and Payment Terms
4.1 Accepted payment methods are prepayment, VISA, Mastercard, PayPal, and Sofortüberweisung (instant bank transfer), unless other arrangements are specified during the ordering process. All prices are in Euros and include the applicable statutory value-added tax. Payment is due at the latest on the day the service is rendered, unless a different agreement has been made. Accepted payment methods are bank transfer or digital payment methods by prior arrangement.
4.2 For payments via PayPal, the General Terms and Conditions (GTC) of PayPal apply, which can be found at www.paypal.com (Link: https://www.paypal.com/de/legalhub/paypal/home#:~:text=Die%20AGB%20und%20die%20Mitteilungen,f%C3%BC….).
4.3 For payments via Sofortüberweisung, the GTC of Klarna Bank AB (publ) apply, which can be found at https://www.klarna.com/de (Link: https://www.klarna.com/de/agb/).
4.4 For prepayment, an invoice will be sent that must be paid within the specified period. The booking confirmation remains the property of Sightseeing Avenue until full payment is received and will be sent to the email address provided during the ordering process after payment has been processed. No liability is assumed for the proper functioning of email communication on the customer's side. If the booking confirmation has not been received via email within 48 hours of purchase, the customer is requested to contact customer service immediately.
4.5 For bookings with an invoice amount of more than €400.00, a down payment of 25% of the total amount must be made within 7 days of receiving the invoice. The remaining balance must be transferred to our account no later than 24 days before the start of the service.
5. Data Protection
All customer-related order data is collected, processed, and used in accordance with the provisions of the German Federal Data Protection Act (BDSG). The customer grants Sightseeing Avenue permission to pass on personal data to natural or legal persons commissioned with the organization and execution of the service, to the respective event organizer.
6. Right of Withdrawal / Cancellation
6.1 Contracts for leisure activities with a specified date or period are excluded from the right of withdrawal according to § 312g para. 2 sentence 1 no. 9 of the German Civil Code (BGB). This applies to individual tickets for tours and events.
6.2 Rescheduling of tickets: Customers can reschedule individual tickets for tours once for free up to 24 hours before the booked start time. Rescheduling requests made later cannot be considered. The rescheduling must be submitted in writing or via email to (info@sightseeing-avenue.de).
6.3 Cancellation of tickets: Customers can cancel individual tickets for tours for free up to 24 hours before the booked start time. For a timely cancellation, the full ticket price will be refunded, minus any fees incurred by credit institutions or payment providers at the time of booking. Cancellations received less than 24 hours before the start of the service cannot be considered, and the ticket price will not be refunded in this case. The cancellation must be submitted in writing or via email to (info@sightseeing-avenue.de).
6.4 Cancellation fees for group bookings: (Bus,- Guide- or Boat rental)

Up to 28 days before the start of the service: 10% of the agreed-upon fee

27 to 15 days before the start of the service: 30% of the agreed-upon fee

14 to 7 days before the start of the service: 45% of the agreed-upon fee

6 to 2 days before the start of the service: 70% of the agreed-upon fee

Less than 24 hours before the start of the service: 100% of the agreed-upon fee
6.5 Refunds will be made within 20 business days to the account specified by the customer, or for online payments, to the original payment method used.
6.6 Sightseeing Avenue reserves the right to cancel services. If force majeure, such as unforeseen severe weather, significantly hinders or makes the performance of the service impossible, Sightseeing Avenue can cancel the appointment.
7. Participant Conduct
Sightseeing Avenue or its authorized city guides are entitled to terminate a service or tour if participants are intoxicated, under the influence of drugs, or for other reasons that endanger the safe execution of the event. In this case, the full payment claim remains.
8. Liability
8.1 Participation in the services offered by Sightseeing Avenue is at the customer's own risk. To the extent legally permissible, Sightseeing Avenue excludes liability for minor negligence.
8.2 Sightseeing Avenue is not liable for accidents that befall participants during a city tour, unless the accident is due to an intentional or grossly negligent breach of duty by Sightseeing Avenue.
8.3 Sightseeing Avenue is not liable for loss, theft, or damage to valuables or other property of participants during the city tour, unless Sightseeing Avenue is responsible for this through intent or gross negligence.
8.4 Liability for damages of any kind, particularly due to inaccurate content, recommendations, or other deficiencies in the services offered, is excluded, unless Sightseeing Avenue is responsible for this through intent or gross negligence.
8.5 These liability limitations also apply to services provided by third parties that are offered to and used by participants as part of the tours.
9. Final Provisions
9.1 The laws of the Federal Republic of Germany apply.
9.2 The place of jurisdiction for all disputes arising from or in connection with these GTC is Hamburg, provided that the customer is a merchant, a legal entity under public law, or a special public fund.
9.3 Should any provision of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
