Version: October 2026 · This is an English translation of our German terms, provided for your convenience. The language of the contract is German; in the event of any discrepancy, the German version shall prevail.
General Terms and Conditions
1 Scope
These General Terms and Conditions (GTC) apply to all contracts for services provided by Sightseeing Avenue, in particular city tours, harbor tours, ship charters, bus rental and transfers – with consumers as well as with businesses and public-sector clients.
For ship charters and bus rental, our “Additional Terms for Ship Charter” and “Additional Terms for Bus Rental” also apply. Further additional terms are stated in the offer and sent with it. The following order of precedence applies: individual agreements, then the additional terms, then these GTC.
Deviating terms of the customer only apply if we expressly agree to them in text form.
2 Conclusion of the contract
Online tickets: By completing the booking, the customer submits a binding offer. The contract is concluded with our booking confirmation by email.
Individual offers (e.g. groups, charters, bus rental): Our offer is valid until the date stated. The contract is concluded when the customer accepts it within the deadline – online via “Accept offer” with the button “Book with obligation to pay”, or in text form. We confirm receipt by email.
We store the contract text. The customer receives it with the confirmation by email, together with these GTC and, where applicable, the additional terms. The language of the contract is German.
Anyone who books on behalf of a group, a company or an association is liable for the obligations under the contract if they expressly declare this or act without authority of representation.
3 Services
We carry out city tours and walking tours ourselves or through tour guides commissioned by us.
For harbor tours, ship charters and bus services, we act as organizer and intermediary. Transport is carried out exclusively by licensed shipping companies or by bus companies licensed under the German Passenger Transport Act (PBefG), under their own responsibility (service providers). Their conditions of carriage and the instructions of their staff also apply on their vehicles and vessels.
The scope of services results from the service description on our website or from the offer. Harbor tour routes depend on the tide and may vary; the Speicherstadt can only be navigated at suitable water levels. Tours take place in any weather, provided safety is not at risk.
Please arrive at the meeting point in good time. Ships and tours depart on time and cannot wait for late participants. There is no entitlement to a refund in the event of late arrival or no-show. A minimum age applies to some tours (e.g. 18 years for the St. Pauli & Red Light District Tour); otherwise minors may only take part when accompanied by a person responsible for their supervision.
Changes: We may replace the guide (e.g. due to illness), make minor adjustments to the schedule or route and use an equivalent ship or vehicle, provided this is reasonable for the customer and does not significantly change the character of the service.
Special needs: Not all ships, vehicles and meeting points are barrier-free. Please inform us of wheelchairs, strollers, animals and any other special needs when booking so that we can clarify and prepare participation with the service providers.
4 Prices and payment
All prices are in euros and include statutory VAT. The accepted payment methods are stated during the booking process or on the invoice. When paying via a payment service provider (e.g. PayPal, credit card), its terms also apply.
Online tickets must be paid for when booking. For bookings on account, the payment term stated on the invoice applies.
For invoice amounts of €1,000.00 or more, a deposit of 25% is due within 7 days of receipt of the invoice. The balance is due no later than 28 days before the start of the service, unless a different payment term is stated on the invoice. For bookings made less than 28 days before the start of the service, the payment term stated on the invoice applies.
The customer receives tickets or vouchers by email once payment has been received in full. If no confirmation has arrived within 48 hours, please contact us (please also check your spam folder).
If a payment due is not received despite a reminder with a reasonable deadline, we may withdraw from the contract and claim compensation in accordance with section 6. Statutory claims for default remain unaffected.
More participants than booked: If more people attend than agreed, we will invoice the additional participants at the applicable prices. If the capacity (e.g. seats on board or in the bus, group size of the guide) is insufficient, we may refuse additional participants.
Reductions: Reduced prices (e.g. for children, students, students or seniors) only apply upon presentation of proof. If proof cannot be provided on request, the difference to the regular price must be paid on site.
Gift vouchers: Where we issue gift vouchers, they are valid for three years from the end of the year in which they were purchased, unless otherwise stated on the voucher. Cash payment is excluded; any unused residual value remains as credit.
5 Data protection
We process personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). We pass on data required for the performance of the service (e.g. name, number of participants, contact details for the day of the service) to the service providers involved (Art. 6(1)(b) GDPR). Details can be found in our privacy policy on our website.
Photos and videos: We occasionally take photos or videos on tours for our website and social media channels. We announce this on site. We only publish recordings in which individual participants are the focus and recognizable with their consent. Anyone who does not wish to be photographed should tell the guide; we will remove recordings that have already been published on request.
6 Right of withdrawal, rebooking and cancellation
No right of withdrawal: There is no right of withdrawal for contracts for services related to leisure activities that are provided on a specific date or within a specific period (Section 312g (2) No. 9 German Civil Code, BGB). This also applies to tickets booked online. We grant the following rules on rebooking and cancellation voluntarily.
Individual tickets – rebooking: Individual tickets for walking tours, harbor tours and the Evening Lights Cruise booked online can be rebooked free of charge once to another available date up to 24 hours before the start of the service.
Individual tickets – cancellation: Individual tickets booked online can be canceled free of charge up to 24 hours before the start of the service; the ticket price will be refunded in full. There is no refund for later cancellation or no-show.
Group tours and private tours with a guide: In the event of cancellation, we charge the following compensation of the agreed total price (receipt of the cancellation before the start of the service). The 10% covers our costs for planning, organization and coordination with the guide, which have already been incurred even in the case of early cancellation:
| Receipt of cancellation before the start of the service | Compensation |
|---|---|
| 15 days or more | 10% |
| 14 to 8 days | 30% |
| 7 to 3 days | 50% |
| 2 days to 24 hours | 80% |
| less than 24 hours or no-show | 100% |
Rebooking to another date is possible free of charge once up to 8 days before the start of the service, provided a guide is available; after that it is treated as a cancellation. If the number of participants is reduced, a flat group price does not change; for per-person prices, a reduction is free of charge up to 3 days before the start of the service. The guide waits at the meeting point for up to 15 minutes; later arrival shortens the tour, the price remains unchanged.
Ship charter and bus rental: The cancellation terms of the “Additional Terms for Ship Charter” and the “Additional Terms for Bus Rental”, which form part of the offer, apply. For third-party services arranged by us (e.g. admissions, catering), the terms of the respective provider stated in the offer apply.
Cancellations and rebookings must be made in text form (e.g. by email to info@sightseeing-avenue.de); the date of receipt by us is decisive. Saved expenses have already been taken into account in the compensation. The customer remains entitled to prove that we have incurred no damage or significantly less damage.
Refunds are made within 14 days to the account provided or via the original payment method.
Cancellation by us: We may cancel a service if force majeure (e.g. severe weather, flooding, official orders) makes it impossible to carry out or endangers safety, or if a minimum number of participants stated in the service description is not reached (cancellation no later than 24 hours in advance). We will inform you immediately, offer an alternative date where possible and refund any amounts already paid in full.
Substitute participants: Tickets are transferable unless they are issued in a name. For groups, the customer may replace individual participants with other persons at any time free of charge.
7 Conduct of participants
The instructions of our tour guides and the staff of the service providers must be followed. Participants who are heavily intoxicated, under the influence of drugs or who endanger the safe performance of the service may be excluded from it. In this case, the claim to payment remains, less any saved expenses. The customer is liable for damage culpably caused by them or their guests.
8 Liability
We are liable without limitation for damage resulting from injury to life, body or health and for damage caused intentionally or through gross negligence.
In the case of slight negligence, we are only liable for the breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on which the customer may rely; liability is then limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
For services that we only arrange (section 3.2), we are liable for careful selection and arrangement. The respective service provider is liable for the performance of the transport in accordance with the statutory provisions applicable to it.
We do not take custody of valuables and clothing brought along; in this respect we are only liable in accordance with section 8.1.
Liability under the German Product Liability Act and mandatory statutory liability provisions remain unaffected.
9 Final provisions
The law of the Federal Republic of Germany applies. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hamburg.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
Additional Terms for Ship Charter
These terms apply to all charter trips booked with Sightseeing Avenue in addition to our General Terms and Conditions. A charter trip exists when a ship (passenger ship or traditional launch, “Barkasse”) with crew is provided for exclusive use. The trip is carried out by a licensed shipping company. Where these terms differ from our GTC, they take precedence for charter trips.
1 Weather, force majeure and replacement ship
If the trip cannot take place as agreed due to force majeure – e.g. severe weather, high or low water, closures of waterways or locks, unforeseen technical defects – or for other reasons for which neither we nor the shipping company are responsible, we will inform you immediately. Insofar as it is reasonable for you, the following then applies:
- Instead of the agreed ship, a ship comparable in size, capacity and equipment may be used.
- The route may be changed. If this is not possible during the trip, the trip may be terminated.
- If no trip is possible, the ship will be provided moored at an accessible pier for the booked time.
- If no ship can be provided at all, we will refund any amounts already paid in full.
No claim for damages arises in these cases. The name, branding or advertising on the ship do not form part of the contract.
2 Withdrawal by the customer (cancellation)
A cancellation must be made in text form (e.g. by email). The date of receipt by us is decisive. In the event of cancellation, we charge the following compensation, in each case of the agreed total price:
| Receipt of cancellation before the day of the trip | Compensation |
|---|---|
| 28 days or more | 10% |
| 27 to 15 days | 30% |
| 14 to 7 days | 45% |
| 6 to 2 days | 70% |
| from 1 day before or no-show | 100% |
Saved expenses have already been taken into account in these amounts. You remain entitled to prove that we have incurred no damage or significantly less damage. We offset amounts already paid against the compensation.
A reduction in the number of participants does not change the charter price. For services charged per person (e.g. catering), changes are free of charge up to 14 days before the day of the trip.
3 Charter time
The price includes 30 minutes each for guests boarding and disembarking on passenger ships and 15 minutes each on launches. Additional time for setting up, dismantling or loading as well as delays for which we are not responsible are charged at the agreed hourly rate. The charter time can only be changed in consultation with us.
4 Catering on board
Food and drinks are only included if expressly agreed.
- On passenger ships, catering is generally provided by the on-board gastronomy. Your own food or external catering is only permitted with our written consent.
- On launches, your own catering is possible; a final cleaning fee may be charged for this.
We are only liable for services of the on-board gastronomy or external caterers if they form part of our contract.
5 Music, permits and decoration
- You register music and dancing on board with GEMA (German music rights society) yourself in good time and bear the fees.
- You obtain official permits for your event in good time at your own expense.
- You indemnify us against third-party claims due to noise or environmental impairment caused by your event.
- Decoration may only be attached with our written consent and must comply with fire safety regulations.
6 Responsibility of the customer
- You are liable for damage to the ship, its fittings, inventory and pier facilities caused by you or your guests.
- Services additionally used by your guests on board will be charged to you.
- Parents or accompanying persons are responsible for supervising children traveling with them.
- Items brought on board are at your own risk.
- Please report defects or disruptions on board immediately so that they can be remedied.
7 Items taken on board and exclusion from the trip
- Dangerous, highly flammable or foul-smelling substances may not be taken on board.
- Bulky luggage, wheelchairs and strollers are possible by arrangement and if space is available.
- Animals may only be taken on board with prior consent.
- Persons who are heavily intoxicated, under the influence of drugs or who endanger safety may be excluded from the trip. In this case there is no entitlement to a refund.
8 Withdrawal by us
We may withdraw from the contract if
- a payment due is not received by us in time,
- the booking was made on the basis of false information, e.g. about the person or the purpose of the event, or
- for a trip on a passenger ship, no catering agreement is reached.
9 Liability for personal injury
Our liability for damage resulting from injury to life, body or health and for damage caused intentionally or through gross negligence remains unaffected. For personal injury during transport, the maximum liability amounts of the German Inland Navigation Act (Section 5k BinSchG) apply.
Additional Terms for Bus Rental
These terms apply to all transfers and exclusive bus rentals (e.g. sightseeing tours) booked with Sightseeing Avenue in addition to our General Terms and Conditions. Transport is carried out by a bus company licensed under the German Passenger Transport Act (PBefG) with its own drivers under its own responsibility; Sightseeing Avenue organizes the service. Where these terms differ from our GTC, they take precedence for bus rental.
1 Scope of services
- A vehicle of the agreed type with driver is provided for the agreed time and route. The occasion and purpose of the trip do not form part of the contract unless expressly agreed.
- The agreed hours and kilometres form the basis of calculation. Additional hours or kilometres – including those caused by traffic jams or diversions – are charged at the agreed rate or pro rata.
- Tolls, parking and other incidental costs as well as overnight accommodation for the driver are only included if expressly agreed.
- The driver's statutory driving and rest periods must be observed; they may limit the schedule.
- For good reason, an equivalent vehicle may be used. If the number of passengers is reduced, a smaller vehicle may also be used.
|---|---|
| more than 30 days | 25%, at least €150 |
| 30 to 15 days | 50% |
| 14 to 7 days | 75% |
| 6 to 2 days | 90% |
| from 1 day before or no-show | 100% |
Saved expenses have already been taken into account in these amounts. You remain entitled to prove that we have incurred no damage or significantly less damage. We offset amounts already paid against the compensation. Additionally booked third-party services (e.g. tour guides, admissions) are charged in accordance with the cancellation terms of the respective provider.
A reduction in the number of participants does not change the rental price. One change to the booking is free of charge; for each further change we charge a processing fee of €30 plus VAT. Additional costs resulting from the change are added.
3 Price changes
If more than four months lie between booking and the day of the trip, we may increase the price by up to 10% if fuel or personnel costs, taxes or levies increase unforeseeably after the booking. We will inform you of the increase and its reason without delay. If it amounts to more than 5%, you may withdraw from the contract free of charge immediately after our notification.
4 Schedule and punctuality
We plan departure times with a sufficient buffer. We are not liable for delays caused by traffic jams, road closures, weather or other circumstances for which we are not responsible; this also applies to consequential costs (e.g. missed appointments). Please inform us of fixed appointments (e.g. flight departure, start of an event) when booking.
5 Luggage
- One suitcase (up to 20 kg) and one piece of hand luggage (up to 7 kg) per person are included. Please register excess or special luggage (e.g. bicycles, wheelchairs, equipment) when booking. Minibuses have less storage space.
- Explosive, highly flammable, corrosive or foul-smelling substances are excluded from transport.
- Luggage and items left in the vehicle are not supervised, including during loading and unloading.
6 Safety and conduct on board
- Seat belts must be worn during the journey (Section 21a German Road Traffic Regulations, StVO). The driver's instructions must be followed.
- You are responsible for the conduct of your guests and liable for damage to the vehicle caused by you or your guests. Cleaning costs for excessive soiling are charged separately.
- You or the accompanying persons are responsible for supervising children and persons in need of assistance. Please register persons with reduced mobility when booking.
- Anyone who fails to follow instructions despite a warning or endangers safety may be excluded from the trip. In this case there is no entitlement to a refund or return transport.
7 Special trips
You must inform us when booking of trips with increased risk – e.g. bachelor and bachelorette parties, trips by football fans, to demonstrations or during announced strikes. If you fail to do so, we may withdraw from the contract; you bear the resulting damage.
8 Force majeure and withdrawal by us
If the trip becomes impossible or considerably more difficult due to force majeure or unforeseeable circumstances such as severe weather, road closures, official orders or strikes for which we are not responsible, both parties may terminate the contract. Services already provided will be charged pro rata; after the start of the trip we will arrange return transport on request. If a payment due is not received in time, we may withdraw after a reminder with a deadline and claim the cancellation compensation in accordance with section 2.
9 Defects and liability
Please report defects to the driver immediately so that they can be remedied, and then to us in text form. Our liability for damage resulting from injury to life, body or health and for damage caused intentionally or through gross negligence remains unaffected. For property damage, Section 23 of the German Passenger Transport Act applies: liability is limited to €1,000 per passenger transported, unless the damage is based on intent or gross negligence.
